These Terms and Conditions (“Terms”) govern your access to and use of the Mulla Network platform (the “Platform”), operated by Mulla Business Limited (“Mulla Network”, “we”, “us” or “our”), in the Republic of Kenya. By registering for, accessing, or using the Platform, you (“you” or “User”) agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, you must immediately cease all use of the Platform.
Affiliate
A natural person or business entity enrolled in Mulla Network’s affiliate programme to promote Products and earn commissions.
Customer
Any person who purchases a Product via the Platform.
Product
Any goods or services listed for sale on the Platform by a Product Owner.
Product Owner
A natural person or legal entity that lists Products on the Platform for sale.
Commission
The fee payable by Mulla Network to an Affiliate for a successful referral sale, as set out in our Affiliate Programme Terms.
Content
Any text, images, logos, audio, video or other material submitted to or displayed on the Platform.
1. You must be at least eighteen (18) years old and capable of entering into a binding contract under the laws of Kenya to register as a User.
2. By clicking “I Agree,” registering, or otherwise accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
To access certain features, you must create an account and provide accurate, complete information.
You are solely responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
If you suspect unauthorized use of your account, you must notify us immediately at support@mullanetwork.com.
Mulla Network serves as an intermediary:
Between Product Owners and Customers: facilitating listing, marketing, payment collection, and order fulfilment.
Between Affiliates and Product Owners: tracking referrals and remitting Commissions for successful sales.
Enrollment: Affiliates must apply and be approved by Mulla Network.
Tracking & Payouts: Affiliate links track referrals. Commissions become payable 30 days after a Customer’s order is marked “Delivered” or “Completed.”
Commission Rates: Set per Product Owner; published in the Affiliate Dashboard.
Prohibited Practices: No cookie‑stacking, self‑referrals, or unauthorised advertising methods. Violations may lead to forfeiture of commissions and account suspension.
Accurate Listings: Provide truthful descriptions, pricing, stock levels, and clear images.
Fulfilment: Timely packing and shipment of orders; compliance with delivery timelines.
Customer Support: Handle inquiries, returns, and refunds per our Return & Refund Policy.
Compliance: All Products must comply with Kenyan laws, including the Consumer Protection Act, 2012, and any sector‑specific regulations.
Transaction Flow: Customers pay through approved payment gateways; funds, less Mulla Network’s service fee and Affiliate commission, are remitted to Product Owners.
Service Fee: Charged to Product Owners at a rate published on our Pricing Page at mullanetwork.com.
Settlement Cycle: Remittances to Product Owners occur within 15 business days of order delivery confirmation; Affiliate payouts follow the same cycle.
All Content on the Platform—including name, logo, design, text, graphics, and software—is owned or licensed by Mulla Business Limited and protected under the Kenyan Copyright Act, 2001, and international treaties.
You may not reproduce, modify, distribute, or create derivative works without our prior written consent.
You agree not to:
Post unlawful, defamatory, or infringing material.
Attempt unauthorised access to other Users’ accounts or our systems.
Use automated tools (bots, scrapers) to extract data.
Engage in “cookie stuffing” or other fraudulent methods to generate commissions.
No Warranties: The Platform is provided “as is” and “as available.” Mulla Business Limited disclaims all warranties, express or implied.
Limitation of Liability: To the maximum extent permitted by law, Mulla Business Limited and its officers, directors, employees, agents, or partners shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising out of your use of the Platform.
You agree to indemnify and hold Mulla Business Limited and its affiliates harmless from claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys’ fees) arising from:
Your breach of these Terms;
Your infringement of any third‑party rights;
Your violation of applicable law.
Mulla Business Limited may suspend or terminate your account at any time, with or without notice, for conduct that violates these Terms or harms other Users.
Upon termination, your right to access the Platform will immediately cease.
These Terms are governed by the laws of the Republic of Kenya.
Any dispute arising under or in connection with these Terms shall be referred to arbitration under the Arbitration Act, 1995, in Nairobi, Kenya, per the Nairobi Centre for International Arbitration rules.
We may modify these Terms and our Privacy Policy at any time by posting the revised documents on the Platform with new “Last updated” dates. Continued use of the Platform after such changes constitutes your acceptance of the revised Terms and Privacy Policy.
